Waiver Summary Text:

SOUTH ASIAN SPORTS

PARTICIPANT WAIVER, RELEASE OF LIABILITY & CONCUSSION ACKNOWLEDGMENT

This waiver applies to all leagues, tournaments, practices, events, and activities organized, hosted, or sponsored by South Asian Sports, including but not limited to:

• South Asian Football League (SAFL)
• South Asian Softball League (SASL)
• South Asian Basketball League (SABL)
• South Asian Cricket League (SACL)
• South Asian Bowling League (SBowl)
• South Asian Ultimate League (SAUL)
• South Asian Pickleball League (SAPL)
  
• Any other sport, program, camp, or recreational activity organized now or in the future by South Asian Sports.

 

ACKNOWLEDGEMENT OF RISK & ASSUMPTION OF RESPONSIBILITY

I, the undersigned participant (or parent/guardian if under 18), acknowledge and understand that:

• Participation in athletic and recreational sports activities involves inherent risks of serious injury or death, including but not limited to sprains, fractures, concussions, cardiac events, paralysis, property damage, or other harm.
• Risks may arise from my own actions, the actions/inactions of others, playing surface conditions, equipment failure, weather, or the negligence of South Asian Sports or its affiliates.
• I voluntarily assume full responsibility for any and all risks, injuries, or damages, whether known or unknown, even if caused in whole or in part by negligence of the released parties.

 

WAIVER & RELEASE OF LIABILITY

In consideration of being permitted to participate, I hereby:

1. Release and Discharge South Asian Sports, its affiliates, owners, directors, officers, coaches, referees, agents, sponsors, volunteers, employees, and all associated personnel from any and all claims, demands, losses, or damages resulting from participation.
2. Indemnify and Hold Harmless the following entities from any and all claims, demands, damages, and liabilities arising from participation:

• Nassau County
• Town of Hempstead
• Town of Oyster Bay
• New York City
• Robert F. Kennedy High School
• Bayside High School
• Wesco Sports
• MDQ Academy
• The Field House
• All venue owners, operators, landlords, agents, contractors, and sponsors
• All other venues that South Asian Sports and it’s subsidiaries rents and or operate. 
  
  

3. This release includes liability for ordinary negligence (active or passive) but does not extend to gross negligence or willful misconduct.

 

4. I understand that South Asian Sports provides supplemental insurance: All medical expenses are my sole responsibility.

 

5. I also release South Asian Sports from any claims relating to COVID-19 or communicable diseases contracted through participation.

 

 

MEDIA RELEASE

I grant South Asian Sports and its affiliates the irrevocable right and permission to use my name, likeness, image, voice, and video/photographs for any promotional, commercial, or editorial purposes in all media, without compensation, review, or approval.

 

NO REFUND POLICY

I understand and agree that all registrations, fees, and payments are non-refundable and non-transferable under any circumstance, including but not limited to: injury, illness, suspension, expulsion, team disbandment, scheduling conflicts, personal issues, or weather-related cancellations.

 

CONDUCT & REMOVAL POLICY

I agree to abide by all rules, regulations, and codes of conduct. I understand that:

• South Asian Sports may suspend or remove any participant or team for unsportsmanlike conduct, unsafe behavior, harassment, or any action deemed detrimental to the league or its participants.
• Decisions of South Asian Sports are final, binding, and not subject to appeal.

 

COMMUNICATION CONSENT

I consent to receive communications via email, text, phone, and digital platforms regarding schedules, updates, and promotional information. I understand I may opt out by following the provided instructions in the emails that go out or text messages that are sent..

 

CONCUSSION ACKNOWLEDGMENT (SABL & SASL and All Leagues)

I acknowledge the following:

• A concussion is a serious brain injury that may affect memory, balance, coordination, and behavior.
  
• Symptoms may appear immediately or be delayed for hours.
  
• If a concussion is suspected, the athlete will be removed from play and may not return the same day.
  
• Return-to-play requires written medical clearance from a licensed healthcare provider and compliance with South Asian Sports’ stepwise return-to-play protocol.
  
• It is my responsibility (and my parent/guardian’s responsibility if under 18) to report all symptoms honestly to coaches, referees, or league officials.

 

BINDING ARBITRATION & GOVERNING LAW

I agree that any dispute, claim, or controversy arising out of or related to my participation shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association. The venue for arbitration shall be Nassau County, New York. I waive the right to a trial by jury or to participate in a class action.

 

AGREEMENT & UNDERSTANDING

By signing below, I confirm that:

• I have read and fully understand this waiver, release, media consent, no-refund policy, conduct policy, concussion protocol, and communication consent.
• I voluntarily agree to all terms, knowing that I am waiving substantial legal rights.
• This release is binding upon me, my heirs, executors, administrators, and assigns.
